1. Welcome to The Creative Cat Sitter

Welcome to The Creative Cat Sitter (“we”, “our”, or “us”)! This website and the services offered are owned and operated by Hannah Skalova (“I”, “my”, “me”). By using my services, you agree to the following Terms and Conditions.

These Terms and Conditions (“T&C”) govern the use of our cat-sitting services, which include, but are not limited to, visits, overnight stays, and additional services as described on our website. By booking our services, you acknowledge and accept these T&C.

2. Services Provided

We offer the following cat-sitting services:

  • Quick Visit: 20-minute visit to check on your cat(s)
  • Basic Visit: 30-45 minute visit with up to 5 pictures/videos and a brief update
  • Advanced Visit: Up to 1.5-hour visit with 5-15 pictures/videos and a comprehensive update
  • Overnight Stay: Full overnight stay with regular check-ins and care for your cat(s)
    Additional services may be available based on availability. Please contact us for more details.

3. Booking and Payments

3.1 Booking: To book our services, please fill out the booking form on our website or contact us directly via email or phone.

3.2 Invoices: Invoices are issued upon confirmation of your booking for upfront payments or immediately following the completion of services for post-service payments. Payment terms and due dates will be clearly stated on the invoice.

3.3 Payment: Payment is due as per the terms outlined on your invoice. We accept bank transfers, online payments, or cash.

3.4 Deposits: A non-refundable deposit may be required to secure your booking. This deposit will be deducted from the total cost of your service. If you cancel the booking, the deposit will not be refunded. If you proceed with the service, the deposit will be subtracted from the total amount due.

3.5 Pricing: Our services are priced as follows:

  • Quick Visit: £10
  • Basic Visit: £12
  • Advanced Visit: £15
  • Overnight Stay: £25

Prices may vary based on location or special requests. Any changes to pricing will be communicated prior to booking.

4. Client Responsibilities

4.1 Clients must provide accurate information about their cat(s), including medical history, feeding schedule, behaviour, and emergency contact details.

4.2 Clients must provide access to their property, including keys or key codes, and ensure the safety of the environment for our staff.

4.3 Clients must disclose any health concerns or behavioural issues their cat(s) may have. If a cat poses a danger to the sitter or others, we reserve the right to refuse or discontinue services.

4.4 Clients must maintain a hygienic and safe living environment. If the property is deemed unhygienic or in a dirty, untidy condition, we reserve the right to refuse or discontinue overnight stays to protect the health and safety of our staff.

5. Access to Property

It is the responsibility of the client to ensure that proper access to their property is provided for the duration of the cat-sitting service. This includes providing a working key or access code, clear instructions, and ensuring that there are no barriers preventing entry.

In the event that:

5.1 The key provided is not working, or we’re unable to access the property for any reason (e.g., wrong key, locked door, or access code issues), we are not responsible for any resulting inconvenience or delays.

5.2 If we cannot access the property to care for your cat(s), we will make reasonable efforts to contact you, but we’re not liable for any failure to provide services.

5.3 If we’re unable to access the property due to access issues, no refund will be given for the missed visit or service.

Please ensure that all access arrangements are made prior to your booking to avoid any disruption to the agreed services.

6. Insurance and Liability

6.1 Insurance Coverage
We are fully insured through Protectivity, which covers public liability, pet care, and key loss. This ensures that your cat(s) and property are protected while under our care. Details of the insurance policy are available upon request.

6.2 Key Loss Responsibility
In the unlikely event that we lose the key to your property, our insurance covers the cost of replacement or rekeying up to £10,000. We take all reasonable precautions to ensure the security of your keys. However, if the loss occurs due to our negligence and costs exceed the insurance coverage, we will be liable for the additional amount.

6.3 Care, Custody, and Control of Animals
Our insurance covers incidents where an animal in our care is accidentally lost, injured, becomes ill, or suffers a fatality, up to a limit of £100,000 per incident and £25,000 per individual animal.

6.4 Non-Negligent Cover
If an animal suffers accidental loss, injury, illness, or death during service delivery, through no fault of our business, our insurance provides additional coverage.

6.5 Travel Expense Reimbursement
In the event a pet in our care is accidentally killed, stolen, or goes missing for more than 48 hours, our insurance reimburses the owner for extra travel expenses incurred, such as cutting a holiday short, up to £1,000.

6.6 Public Liability
We are insured for public liability up to £1,000,000 for any one occurrence, ensuring that any incidents affecting third parties are adequately covered.

6.7 Excess Fees for Insurance Claims
Please note that an excess fee of £50 applies to claims made under some parts of the policy. If an incident occurs during the course of service delivery, through no fault of our business (e.g., accidental injury or illness), the client will be responsible for covering the £50 excess fee required by the insurance. If the incident arises due to our negligence, we will cover this cost.

7. Health and Safety

We will care for your cat(s) with the utmost attention and care. However, we are not responsible for any illness, injury, or damage occurring during the service unless caused by our negligence. We reserve the right to refuse care if the cat(s) are deemed dangerous or unfit for the service.

In case of emergency, we will make every effort to contact your designated emergency contact and/or take the cat to the nearest vet. We are insured for pet transportation, covering up to £100,000 per incident (£25,000 per individual animal), with a £50 excess fee. Veterinary costs remain the owner’s responsibility unless the incident is due to our negligence.

8. Photography and Image Rights

As part of our services, we may take photos of your cat(s) in various contexts, including during routine cat-sitting visits and standalone photography sessions. By booking our services, you agree to the following terms:

Photos Taken During Cat-Sitting Visits

8.1 Client Updates: Photos taken during cat-sitting visits are primarily used to provide updates on your cat’s well-being. These photos will be sent to you via WhatsApp, email or another messaging app, as per your preference.

8.2 Marketing and Promotional Use: With your consent, photos of your cat(s) may also be used for marketing and promotional purposes, including on our website, social media, or other materials. Your cat’s name may be included in these photos, but no personal details about your location or home will ever be shared.

8.3 Opting Out of Marketing Use: If you do not wish for your cat’s photos to be used for marketing, you can inform us at any time. Simply contact us at hello@creativecatsitter.co.uk, and we will ensure your preferences are respected.

8.4 Removing Photos: If you wish to have photos removed from our website or social media after they have been shared, we will promptly comply with your request.

Standalone Photography Sessions

8.5 Ownership and Usage Rights: For standalone photography sessions, you will receive full-sized, edited images. Upon receipt, you have full authority over these images and are free to share, print, or distribute them as you wish. No credit to The Creative Cat Sitter is required unless otherwise agreed.

8.6 Social Media Credit for Cat-Sitting Photos: For photos taken during routine cat-sitting visits (not standalone photography sessions), you are required to credit The Creative Cat Sitter if you share these images on social media or other platforms.

8.7 Copyright and Commercial Use: All images remain protected by copyright law. While you are granted usage rights for personal purposes, commercial use of any photos is prohibited without prior written consent from us.

9. Cancellations and Refunds

9.1 If you need to cancel or modify your booking, please do so at least 5 days in advance. Cancellations within less than 48 hours may incur a 25% cancellation fee, in addition to any non-refundable deposit.

9.2 In the event that we need to cancel a booking, we will inform you as soon as possible and offer a full refund or alternative arrangements.

9.3 No refunds will be issued for services already rendered.

10. Liability

10.1 We are not liable for any damage, injury, or loss that occurs during our cat-sitting services, except where caused by our negligence. We are not responsible for any pre-existing conditions or accidents that may occur while the cat(s) are under our care.

10.2 We are not liable for failure to perform our services due to events beyond our control, including but not limited to natural disasters, travel disruptions, or illness.

11. Confidentiality

We respect your privacy and will not share any personal or pet-related information with third parties, except as required by law or with your explicit consent. All client details and pet care information will be stored securely and managed in compliance with applicable data protection laws, including the Data Protection Act 2018 and the General Data Protection Regulation (GDPR).

12. Dispute Resolution

If you have any issues with our services, please contact us directly. We will work with you to resolve the matter. In the case of unresolved disputes, we agree to seek mediation or arbitration before pursuing legal action.

13. Amendments

We reserve the right to modify or amend these Terms and Conditions at any time. Any changes will be posted on this page, and the updated date will be indicated at the top of the page.

14. Your Right to Use the Website and Services

14.1 The content, images, branding, and materials on this website belong to us and are protected by copyright and other intellectual property laws. You may use this content for personal purposes only, in line with these Terms and Conditions.

14.2 You are not permitted to copy, modify, distribute, or reproduce any part of this website or its content without our written consent.

14.3 Unauthorized attempts to access, modify, or distribute the website’s code, services, or materials are strictly prohibited.

15. Governing Law

These T&C are governed by and construed in accordance with the laws of the United Kingdom, and any disputes will be subject to the exclusive jurisdiction of the courts located in Ipswich, Suffolk. In the event of a complex case, the dispute may be moved to a higher court in a nearby city, such as London or Norwich.
